These Terms of Service ("Terms") govern your use of the CardDrop mobile application and related website (together, the "Service"), operated by Golden Road Games LLC ("CardDrop," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements. The Service is intended for use in the United States.
CardDrop lets you design personalized photo cards and postcards, share them digitally (SMS, email, or a shareable link), and optionally have them printed and mailed as physical postcards through a third-party print-and-mail fulfillment partner ("Print Partner").
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information (including any mailing addresses you submit) and keep it up to date. Notify us promptly of any unauthorized use of your account.
"Your Content" means the photos, text, designs, recipient names, and mailing addresses you upload or enter into the Service.
You agree not to use the Service to:
We reserve the right to review, remove, or refuse to process any content submitted for printing, and to suspend or terminate accounts that violate this section, at our discretion.
Automated checks. We automatically check the photos and text you add to a card, and the names and addresses you use for mailing. Content that is blocked cannot be sent. If an account repeatedly submits blocked photos or harassing content, we may suspend it and the devices it uses, without further notice.
Reports from recipients. Anyone who receives a card can report it. If a recipient reports a card you sent, you will be warned and you will no longer be able to mail to that recipient's address; if you are reported repeatedly, we will suspend your account and the devices you use, without further notice. Digital cards are sent from your own device through your own messaging and email apps, not by us, and you are solely responsible for the cards you send and the recipients you choose. A card that is reported is hidden and locked: you will not be able to view it in the app, delete, resend or copy it, and we keep it for about 365 days before deleting it, even if you delete your account.
Replies. Anyone who opens a card link can reply to it, so replies come from people we don't know and don't control. Replies must follow the rules in this section. We check replies automatically and may refuse any reply, and we limit how many can be sent from one connection. These checks are not perfect, and we do not guarantee that harmful replies will never reach you. You can turn replies off for any card or for your whole account, and you can delete individual replies, in the app.
Physical postcards are printed and mailed by our third-party Print Partner. We are not responsible for postal delivery delays, non-delivery, or damage that occurs once an order enters the mail stream. Estimated delivery windows shown in the app are estimates only and are not guaranteed. You are responsible for entering accurate recipient addresses; we are not liable for cards misdelivered due to incorrect address information you provided. If a recipient has asked not to receive mail from you, or from CardDrop, we will decline to print and mail to that address, and you will not be charged.
The Service relies on third-party providers, including but not limited to Apple (App Store, Sign in with Apple, push notifications), Stripe (payment processing), Supabase (data storage and authentication), OpenAI (automated content-safety checks), and our Print Partner (print and mail fulfillment). Your use of the Service is also subject to those providers' own terms where applicable.
The Service itself, including its software, design, branding, and content we create (excluding Your Content), is owned by Golden Road Games LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the Service except as permitted by law.
You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or are reported repeatedly by recipients, at our discretion, with or without notice. While an account is suspended, the links to all of its cards stop working. We may, but are not required to, review a suspension or restore an account; you can ask for a review using the appeal form on the Account Suspended screen in the app, or contact support at the address below. We may decline to review a repeat suspension. We may keep a record of a suspension, including a verified email address, so that a suspended person cannot create a new account. If we terminate an account, we may delete it and its content, including a suspended account that is not appealed, except for the records described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 5, 9, 11, and 12) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN ROAD GAMES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and CardDrop only, not Apple, and Apple has no obligation to furnish maintenance or support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Questions about these Terms can be sent to support@carddropapp.com.
